Your Contract The 'lead name' who shall be over 21, on the booking guarantees that he/she has the authority to accept the terms of these conditions. A contract will exist as soon as we issue our booking confirmation. This contract, which may include conditions are governed by English Law. On receipt of your completed booking and deposit(s) we will reserve your Holiday in respect of all persons listed. Please check the details are exact as you requested. In the event of any discrepancy, contact us immediately. If you want to cancel or change your booking later, you may have to pay costs (see further down). All website descriptions are made in good faith and every care is taken to ensure their accuracy. However, in view of the detail contained therein and the fact that websites are necessarily prepared/created some time in advance of distribution and of the Holidays, advertised facilities, amenities, entertainment and schedules may on occasion, be restricted, curtailed, changed or cancelled. In these circumstances, (and if we are aware) we will notify you of such changes prior to confirmation of your booking. If you have already booked, where possible, we will notify you as soon as we are aware, if there is time before you travel. Holiday Price When making the booking you must pay a deposit of 10% or £75 (whichever is the highest) of the holiday cost. The balance of the price of your holiday must be paid at least 6 weeks prior to start date. Bookings made within 28 days of the holiday, must pay the total price of the Holiday at the time of booking. If the deposit and/or balance is not paid in time, we shall cancel your holiday. If the balance is not paid in time, we shall cancel your booking and retain your deposit. The prices on this website are correct at time of website publication, however, we reserve the right to raise or lower its prices at any time. Before you make a booking we will give you the up-to-date price of your chosen Holiday, including the cost of any supplements which you have requested. If you change your booking after our confirmation invoice has been issued, we will do our utmost to make these changes, but it may not always be possible. Any request for changes to be made must be from the 'lead name' on the booking. You will be asked to pay an administration charge of £25 per caravan and any further cost we incur in making this alteration. You should be aware that these costs will increase the closer to the arrival date that changes are made and you should contact us as soon as possible. Further changes may be classed as major changes, which may result in cancellation charges being applied.To cancell any holiday we must receive notification by post or e-mail from the 'lead name' on the booking. Since we incur costs in cancelling your holiday arrangements, you will have to pay the applicable cancellation shown here. More than 56 days (loss of deposit), 56 to 29 days (50%), 28 to 15 days (75%) 14 days or less (100%). We do therefore suggest that you seek personal holiday insurances. Occasionally we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor. However, we will not cancel your holiday booking less than 8 weeks before your departure date, except for reasons of unforeseen circumstances beyond our control or failure by you to pay the final balance. If we are unable to provide the booked holiday, you can either have a refund of all monies paid or accept any offer we make of alternative holiday arrangements. Accidents Please note that we will not be liable for any injury, illness, or death or consequent losses suffered by you or any member of your party. In all claims of whatever nature we will not be liable unless it can be proved we knew and failed to take correct action.Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities within the boundaries of the site or outside it. Data Protection Except where expressly permitted by the Data Protection Act, we will only deal with the personal details you give us in respect of your holiday arrangements, unless you agree otherwise. For example, if we wish to use any of your personal details for marketing purposes, we will tell you this when we ask for your details and give you the opportunity to say no if you do not want us to do so. Damages Where damages or losses occur to caravan or items included in the letting agreement Aztec Holidays must be informed immiediatly. Should it be found that any of the party therein were negligent in due care and attention, then the lead name of the agreement during that letting must make good by replacing or paying for said item/s. The cost of replacing items, repairing items, extra cleaning of items will be at our discretion and the amount will be deducted from the security deposit. Be aware that these are non smoking caravans and should evidence be found that smoking has occured within the caravan then a charge will be raised to allow for the extra cleaning, currently this is a minimum of £30. Should costs exceed the security deposit then an invoice will be raised against the lead name. Failure to pay the invoice amount within 10 days will result in civil court action to reclaim the amount. Behaviour Should it be brought to our attention by site officials that unruely or unsociable behaviour is occuring by the lead name or any of the party therein action will be taken to remove the party from the site. Under these circumstances no refund will be offered.
Agreement By payment of deposit or in full for the holiday letting you are agreeing to the terms and conditions laid out above. Completion and sending back by e-mail is accepted as signed within English law.
